These Terms of Service ("Terms") govern your use of the OMNIII mobile application ("App") developed by Don Allen Stevenson III ("Developer", "we", "us"). By downloading, installing, or using OMNIII, you agree to these Terms.

Plain language: OMNIII is a voice-first AI tool that runs on your device. You bring your own API keys for cloud AI services. We do not collect your data or require an account.

1. Acceptance of Terms

By using OMNIII, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

OMNIII is a voice recording and AI assistant application for iOS. The App provides:

On-device voice recording and transcription
AI-powered responses via third-party model providers
Multi-model consensus analysis
Local data storage with no cloud sync

3. User Responsibilities

You are responsible for:

Any API keys you enter into the App and any costs incurred through third-party AI services
The content of your voice recordings and prompts
Complying with the terms of service of any third-party AI providers you access through OMNIII
Using the App in accordance with applicable laws

4. Third-Party Services

OMNIII routes requests to third-party AI services (including OpenRouter, OpenAI, and ElevenLabs) using API keys you provide. We are not responsible for:

The availability, accuracy, or content of responses from third-party AI models
Charges incurred on your third-party API accounts
Changes to third-party service terms, pricing, or availability

5. AI-Generated Content

Responses provided through OMNIII are generated by third-party AI models and are for informational purposes only. AI-generated content may be inaccurate, incomplete, or inappropriate. Do not rely on AI responses for medical, legal, financial, or safety-critical decisions.

6. Intellectual Property

The OMNIII application, including its design, code, and branding, is the intellectual property of Don Allen Stevenson III. Your voice recordings, transcripts, and personal data remain yours.

7. Disclaimer of Warranties

OMNIII is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of OMNIII, including but not limited to data loss, API charges, or reliance on AI-generated content.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how data is handled. In summary: all data stays on your device, we collect no analytics, and there are no user accounts.

10. Modifications to Terms

We may update these Terms from time to time. The effective date at the top of this page will be updated accordingly. Continued use of OMNIII after changes constitutes acceptance of the updated Terms.

11. Termination

You may stop using OMNIII at any time by deleting the App. Upon deletion, all locally stored data is permanently removed from your device.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
